Guardianships – Emergency

Emergency guardians have similar responsibilities to long-term guardians, but guardianship has a time or situational limit.

What is an emergency guardianship?

Emergency guardians are designated individuals who temporarily make decisions for an incapacitated person. If a person is temporarily incapacitated due to illness or accident, for example, an emergency guardian is put in place to make decisions on behalf of the ward. These guardianships have a limiting factor and will not be indefinitely implemented. Examples of limiting factors include the incapacitated person’s time limit or recovery.

Setting up an Emergency Guardianship.

Guardianships can be created before any emergency type of situation has unfolded.  You can make your own preparations and have a guardian already designated while you are in good health to prepare for the unexpected.  Guardianships can also be authorized once a person is already incapacitated.  The court appoints these guardianships, and Braggs Law Firm can help represent your interests in guardianship hearings for a loved one.
